In some cases, online gambling is legal, while in others it is prohibited. For instance, gambling is legal in a few states in Canada and the Caribbean. In the United Kingdom, it is illegal. Some countries, like France, have proposed new laws to regulate internet gambling.

For instance, the Bubba Technology Group, LLC, was operating an illegal gambling business in Piedmont, South Carolina. The company pleaded guilty and forfeited $670,000 in gaming houses affiliated with the company. The Department of Justice argued that the operation violated the Unlawful Internet Gambling Enforcement Act. In addition, the company allegedly committed money laundering.
The Department of Justice has been working with the SLED (Southern Local Enforcement Division) to combat illegal gambling operations. In a recent case in South Carolina, the SLED helped the Cherokee County Sheriff’s Office investigate a gambling operation. In this investigation, agents from the SLED and the Greenville County Sheriff’s Office testified in court.
The Department of Justice’s move in this case may have no legal basis. Some critics argue that the Commerce Clause doctrine prevents states from enforcing their own laws against online gambling. Additionally, some argue that the Wire Act of 1961, which was drafted before the Internet existed, does not apply to digital wagering.
